Program Overview

A Certificate of Occupancy (CO) is required for all new businesses moving into a space without construction or remodeling work that would otherwise require a building permit. This includes situations where a business is simply changing tenants or uses within an existing building. Additional scenarios where a CO is required are outlined below.

The purpose of this program is to help business owners and tenants understand the requirements for safely occupying a commercial space in the City of Rogers. It ensures compliance with the Minnesota State Building Code, State Fire Code, and local ordinances, while promoting a safe and functional environment for employees and customers.

This process is designed to help avoid costly missteps—such as selecting a location that may not be suitable for the intended use due to code restrictions or occupancy limitations.


When is a Certificate of Occupancy Required?

A Certificate of Occupancy is typically required in the following situations:

  • New Business Moving into an Existing Space
    When a new tenant is occupying a space without making construction changes.

  • Change in Use or Occupancy Type
    Even if no construction is taking place, a change in how the space is used (e.g., office to retail, warehouse to assembly) may trigger CO requirements due to different code standards.

  • Change in Business Ownership or Name
    A new business entity taking over an existing space may require a CO, even if the use remains the same.

  • Vacant Space Being Reoccupied
    If a space has been vacant for an extended period, a CO may be required before it can be reoccupied.

  • Shared or Multi-Tenant Spaces
    When a new tenant is added to a multi-tenant building or plaza.

  • Home Occupations with Customer Traffic
    In some cases, home-based businesses that involve customer visits may require review for compliance.

Submittal Requirements for Industrial or Commercial Structure:

  • SAC Determination Form
    This is to be submitted to the Metropolitan Council (651-602-1421) and is required prior to submitting this permit application.

    • Verification that you submitted for a SAC determination must be uploaded when first submitting for this permit. This will be your email notification from Met Council once your application is received by them.

    • The Certificate of Occupancy permit will be approved after the SAC determination has been completed by Met Council (this typically takes 5-10 business days).

    • If any SAC fees are required by Met Council, they will be added to the CO permit.

General Information & Inspection Process

Before a Certificate of Occupancy permit is approved, City staff will review the submitted application and associated details. This review process typically takes three to four business days. Once approved, the applicant will receive an email notification indicating that the permit is ready for payment.

After payment is received, the applicant must schedule a Certificate of Occupancy walk-through inspection by calling the building department at (763)-428-0933. This inspection will be conducted jointly by a Building Inspector and a Fire Inspector, along with the business representative.

  • Provide written feedback to both the prospective business and the property owner regarding any required repairs, improvements, or code-related concerns.
