Requirements for Peddlers and Solicitors

According to Rogers City Code, all peddlers and solicitors must obtain a permit prior to beginning soliciting within the City.  Each applicant will submit their application to the Rogers Police Department. Failure to comply with city ordinances may result in revocation or suspension of a license.

Allowable hours for door-to-door sales are 9 a.m. to 8 p.m. Solicitors cannot harass, intimidate, abuse, or threaten residents. If a peddler or solicitor is told to leave, he or she must comply. Residents should call 911 as soon as possible with concerns and complaints about a solicitor.

  • Submit your permit application in person at the Rogers Police Department during business hours.

  • Applications must be fully completed and legible.  Do not leave any lines blank.  If a question does not apply, indicate “N/A” for not applicable.

  • Must present a current government-issued identification card or driver’s license.

  • The applicant will supply two recent, colored photographs of themselves, approximately 2” x 2”.

  • The permit fee is $20.00 per business plus $50 per person soliciting.  Cash (exact amount) or check made payable to the City of Rogers.

  • Allow a minimum of five working days for the application to be processed.

  • No peddling or soliciting until a permit has been issued.  Peddling or soliciting prior to issuance of a permit is a violation of the City Ordinance and is cause for denial and/or arrest.

  • Permits expire on December 31st of the current year, regardless of the date issued.

  • The fee is not pro-rated and is non -refundable.

  • Solicitors should have their permit visible on their person and are required to show their permit when asked.

Prohibited Practices

It is prohibited for a peddler, solicitor or transient merchant to do the following:

  • Obstruct the flow of vehicular or pedestrian traffic on any street, alley, sidewalk or other public right-of-way.

  • Create a threat to the health, safety, or welfare of any individual or the general public.

  • Entering private property to make a sale or solicitation between the hours of 9 a.m. and 8 p.m, unless the owner or occupant of the property has made arrangements for the salesperson to arrive during those hours

You may not solicit at any residence that displays a placard or sign at the primary entrance stating “Peddlers and Solicitors Prohibited.”

Exceptions

In some cases, the city cannot prevent individuals from going door-to-door, especially in cases that involve literature distribution, because it could tread on an individual’s First Amendment right to free speech. Exceptions include:

  • Individuals selling newspaper subscriptions.

  • Individuals soliciting money, donations or financial assistance of any kind for nonprofit, religious, political or educational organizations. This includes taking orders for goods sold by these organizations; or selling or distributing literature or merchandise for which a fee is charged or solicited on behalf of such an organization.

  • Individuals calling upon households in connection with a regular route service for the sale and delivery of perishable foods, such as bakery and dairy products.

  • Individuals calling upon a household at the request of someone living in the home.

Violators
